I. Right to information

LeQuid takes its clients very seriously and goes to great lengths to ensure that their personal data and privacy is protected. For this reason, we always fully comply with data protection legislation in force at any given time, to guarantee that your personal information is safeguarded.

This data protection policy governs the access and use of the Web site service www.lequid.eu (hereinafter the “Web site”) provided by LeQuid Abogados SLP (hereinafter LEQUID) for those internet users (hereinafter the “Users”), interested in the contents (hereinafter the Contents) hosted on the Web site.

In accordance with the provisions of the Spanish Organic Act 15/1999 of 13 December on the Protection of Personal Data (hereinafter LOPD) and its implementation regulation LEQUID, owner of the Web site, informs the User of this site of the existence of an automated file of personal data created by and under the responsibility of LEQUID.

 

II. Purpose

The personal information collected through this website is necessary for the administration and management of some of our services, such as:

  • Communication with clients through various channels, which include email, telephone, fax, etc.
  • Data analysis, as our main objective is to improve the services and user experience offered, analyse the number of page visits, number of visits as well as visitor activity and time spent on site. The statistical information prepared by the Internet Service Provider is used for these purposes.
  • This website contains links to external websites, which are governed by privacy policies extraneous to LeQuid. You can decide whether or not to accept these privacy policies or cookies when accessing such websites. In general, you can accept or reject third party cookies when browsing on the Internet, using the options in your browser settings.

 

III. Mandatory or optional nature of the information provided by the User and veracity of the data

The User guarantees that the personal data submitted to LEQUID are truthful and that he is responsible for the notification of any modifications.

The veracity of the information provided is, in any case, the User´s responsibility, and LEQUID reserves the right to exclude all registered services to any User who has supplied false information, without prejudice to the other actions under the Law.

 

IV. User´s Consent

Sending personal data by using the Web site form for sending e-mail messages, explicitly implies the consent of the sender to the automated processing of the data included in the indicated media, products and services related to the purposes of this law firm, as well as the sending of communications by any means (mail, telephone, fax, e-mail or any other electronic means) with information related to LEQUID and its initiatives. The User also expressly consents to the transfer of his data to third parties in order to carry out the Service.

 

V. Security

LEQUID maintains the security levels regarding personal data protection in compliance with the Royal Decree 1720/2007 of 21 December, which approves the Regulation regarding the implementation of the Spanish Organic Act 15/1999 of 13 December on the Protection of Personal Data and has established all the technical means available to prevent the loss, misuse, alteration, unauthorized access and theft of data provided by any User through the Website, informing however that the Internet security measures are not impregnable.

LEQUID agrees to comply with the duty of secrecy and confidentiality with regard to the personal data the automated file contains, in accordance with the applicable legislation and to confer a secure treatment in the event of assigning and transferring the data internationally.

Nevertheless, LEQUID cannot be held responsible for: (I) the continuity and availability of the content and services; (II) the absence of error in the said content nor the correction of any defects that may occur; (III) the absence of viruses and/or other harmful components; (IV) damages or losses caused by anyone who violates “Le Quid” security systems.

 

VI. Cookies and IPs

The User accepts the use of cookies and IP tracking. Our site traffic analyser uses cookies and IP tracking permitting us to collect data for statistical purposes, such as: date of first visit, number of times visited, date of last visit, URL and domain information, browser used and screen resolution. However, users can disable and / or eliminate these cookies by following the instructions in his browser.

LEQUID does not use spamming techniques and only processes the data the User transmits through the electronic forms on the Web site or by e-mail.

The processing of personal data, and the sending of commercial communications by electronic means, are in accordance with the Spanish Organic Act 15/1999 of 13 December on the Protection of Personal Data and Act 34/2002 of 11 July, on Information Society Services and Electronic Commerce (B.O.E. 12/07/2002).

 

VI. Objection, Correction and Data Updating

In compliance with the provisions of article 5 of LOPD (Organic Law on Data Protection), you are advised that personal data collected from users through the different means available in the website, will be handled confidentially and maintained in the respective files under LEQUID´S responsibility, for the aforementioned purposes.

To guarantee that users have power of control over their personal information, and always in compliance with the law in force, those involved can exercise their rights of access, rectification, cancellation and opposition (ARCO) at any time.

What are ARCO rights?

Right to Access

The Right to Access gives citizens the power to protect their privacy and control how their personal information is used. Regulation of this right can be found in heading III of LOPD (article 15) and in heading III of Royal Decree 1720/2007 (articles 12 to 26 and articles 27 to 30)

Rights to Rectification and Cancellation

Regulation of the Right to Rectification and Cancellation can be found in article 16 of LOPD and in articles 31 to 33 of Royal Decree 1720/2007. When a citizen’s personal information appears as incomplete, inaccurate, excessive or insufficient, they can request that the person responsible for the file either modifies or cancels this information.

Right to Opposition

Regulation of the Right to Opposition can be found in articles 36 to 36 of LOPD (Royal Decree 1720/2007). This right basically entitles the owners of such information to request that the person responsible for the files stops using their information for advertising or commercial purposes.

VII. Amendments of this privacy policy

VIII. Special conditions

The clauses between the User and DUTILH concerning the protection of personal data contained in special conditions, always prevail over this Data and Privacy Protection Policy.

 

IX. Intellectual Property

All intellectual property rights contained in this website and its graphic design, are LEQUID exclusive property, and shall have exclusive rights of exploitation thereof.

According to the Royal Legislative Decree 1/1996, 12th, April, which approved the revised text of the Intellectual Property Act, as well as the Law 17/2001, 7th of December, on trademarks and the complementary legislation on intellectual and industrial property, it is prohibited the reproduction, transmission, adaptation, translation, distribution, public communication, including making it available, or any type of exploitation and/or total/ partial modification, without previous consent of LEQUID.
