Facebook has again amended its regulations on promotions that apply from 11 May, 2011 (replacing the previous version of 1 December, 2010).

In a previous article, we referred to the amendment of the regulations on promotions on Facebook.

So, new year, new rules, and Facebook has issued new regulations on promotions that can be consulted on http://www.facebook.com/promotions_guidelines.php.

These regulations will apply to contests or sweepstakes that are conducted through Facebook. . Facebook first reminds those conducting promotional sweepstakes or contests that compliance with the rules of Facebook does not absolve the organizers from  compliance with the general regulations of promotional sweepstakes and contests of each country (in this case Spain) in relation with such promotions (“If you use Facebook to communicate about or administer a promotion, you are responsible for the lawful operation of that promotion, including the official rules, offer terms and eligibility requirements (e.g., age and residency restrictions), and compliance with regulations governing the promotion and all prizes offered in connection with the promotion (e.g., registration and obtaining necessary regulatory approvals).  Please note that compliance with these Guidelines does not constitute the lawfulness of a promotion.  Promotions are subject to many regulations and if you are not certain that your promotion complies with applicable law, please consult with an expert.”)

 

Therefore, companies wishing to conduct sweepstakes on Facebook should take into account, apart from the administrative requirements of prior notification and/or authorization from the Spanish State Lotteries (LAE) and payment of the corresponding fees, the following issues:

• You cannot administer a promotion directly through Facebook, but by an application that is on a Facebook.com page (either on the main page of the application or on the tab of a page).

• Participants should be informed of the dissociation of Facebook in the promotional sweepstakes and with respect to the participants.

• You cannot use Facebook features as registration mechanisms in the promotion (e.g., that when clicking on “Like” you are automatically registered in the promotion).

• You cannot condition participation upon the user taking any action in Facebook other than indicating he likes a page, registration in a place, or connecting to an application.  (For example, you cannot condition registration or participation upon the user liking a wall post, or commenting or uploading a photo on a wall).

• You cannot use the “Like” button as a mechanism for voting in the promotion.

• You cannot notify the winners via Facebook, hence it will be necessary to collect the participants’ personal data to notify the winner and always through the application of a third party.

• Finally, it is prohibited to use Facebook´s name, trademarks, trade names, copyrights or any other intellectual property in connection with a promotion, or to mention Facebook in the conditions or materials of the promotion, except to fulfill the obligation to mention the dissociation of Facebook with regard to the promotion.

 

Facebook ha modificado de nuevo su normativa sobre promociones que se aplica desde el 11 de mayo de 2011 (en sustitución de la anterior versión de 1 de diciembre de 2010)

En un artículo anterior, hicimos referencia a la modificación de la normativa sobre promociones en Facebook.

Pues bien, nuevo año, nuevas reglas y Facebook ha publicado una nueva normativa sobre promociones que puedes consultar en http://www.facebook.com/promotions_guidelines.php

Estas normas serán de aplicación a los concursos o sorteos promocionales que se lleven a cabo a través de Facebook. Lo primero que hace Facebook es recordar a los que realicen sorteos o concursos promocionales que el cumplimiento de la normativa de Facebook no exime a los organizadores del cumplimiento de la normativa general sobre sorteos y concursos promocionales de cada país (en este caso España) en relación con este tipo de promociones (“Si utilizas Facebook para administrar una promoción o enviar comunicaciones acerca de ella, serás responsable de que el funcionamiento de la promoción cumpla la legalidad vigente”, “Ten en cuenta que el cumplimiento de estas normas no implica que la promoción cumpla todos los requisitos legales. Las promociones están sujetas a muchas normativas, así que si no estás seguro de que tu promoción cumpla la legalidad vigente, consulta a un experto”).

Por tanto, las empresas que deseen realizar sorteos promocionales en Facebook deberán tener en cuenta, además de los requisitos administrativos de comunicación previa y/o autorización de Loterías y Apuestas del Estado (LAE) y del pago de las tasas correspondientes, las siguientes cuestiones:

• No se puede administrar una promoción directamente a través de Facebook, sino mediante una aplicación que esté en la página de Facebook.com (bien en la página principal de la aplicación o en la pestaña de una página).

• Se deberá informar a los participantes de la desvinculación de Facebook en el sorteo promocional y con respecto a los participantes.

• No se pueden utilizar funciones de Facebook como mecanismos de registro en la promoción (Ej. Que al pinchar en “Me gusta” quedes automáticamente registrado en la promoción).

• No se puede condicionar la participación a que el usuario lleve a cabo algún tipo de acción e Facebook a menos que se trate de indicar que le guasta una página, registrarse en un lugar o conectarse a una aplicación (Ej. no se puede condicionar el registro o la participación a acciones como indicar que le gusta una publicación en el muro, o comentar o cargar una foto en un muro).

• No se puede utilizar el botón “Me gusta” como mecanismo para votar en la promoción.

• No se puede notificar a los ganadores a través de Facebook por lo que será necesario recabar datos personales de los participantes para poder notificar al ganador y siempre a través de la aplicación de un tercero.

• Por último, queda prohibido utilizar el nombre, las marcas comerciales, los nombres comerciales, los copyright ni ninguna otra propiedad intelectual de Facebook en relación con una promoción, ni mencionar a Facebook en las bases o materiales de la promoción, excepto para cumplir las obligación de mencionar la desvinculación de Facebook a la promoción.
